Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

The Service is available only to individuals who are at least 18 years of age and capable of entering into a legally binding agreement under Indian law. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to suspend or terminate accounts of users who do not meet these requirements.

3. Description of Service

Aaradhya is a real estate listing platform that connects property seekers with property owners, landlords, and agents. We facilitate property discovery and communication but are not a party to any transaction, agreement, or dispute between users. We do not act as a real estate broker, agent, or intermediary.

4. User Accounts

You agree to:

• Provide accurate, current, and complete information during registration and keep your account information updated.
• Maintain the security and confidentiality of your login credentials and not share your account with others.
• Promptly notify us of any unauthorized use of your account at support@aaradhyahomes.com.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that provide false, misleading, or incomplete information, or that we reasonably believe are being used in violation of these Terms.

5. Property Listings

If you create property listings, you represent and warrant that:

• You have the legal authority or authorization to list the property.
• All information in the listing is accurate, current, and not misleading.
• The listing does not violate any applicable law, regulation, or third-party rights.
• The listing does not contain discriminatory language or violate fair housing laws.

We reserve the right to remove, edit, or disable listings that we determine, in our sole discretion, violate these Terms or are otherwise objectionable. We may also report fraudulent listings to law enforcement.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Post false, misleading, or fraudulent property listings.
• Harass, threaten, intimidate, defame, or harm other users.
• Upload or transmit malware, viruses, worms, Trojan horses, or other malicious code.
• Attempt to gain unauthorized access to any part of the Service, other user accounts, or connected systems or networks.
• Use automated systems (bots, scrapers, crawlers) to access or collect data from the Service without our prior written consent.
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
• Circumvent, disable, or interfere with security features, rate limiting, or access controls.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Use the Service to send unsolicited communications, spam, or chain letters.
• Circumvent payment requirements or premium feature restrictions.

7. User-Generated Content

You retain ownership of any content you submit to the Service (including property listings, images, descriptions, and reviews). By submitting content, you grant Aaradhya a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

You represent that your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party. You are solely responsible for the content you post and the consequences of publishing it.

8. Payments and Subscriptions

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees for your selected subscription plan (currently ₹49/month for Premium).
• Authorize Cashfree to process payments on your behalf using the payment method you provide.
• Understand that subscriptions auto-renew at the end of each billing cycle unless cancelled at least 24 hours before renewal.
• Understand that refunds are issued solely at our discretion and are not guaranteed.
• Understand that all fees are inclusive of applicable GST and other taxes.

We reserve the right to modify pricing with 30 days' prior notice to registered users. Price changes will take effect at the start of your next billing cycle.

9. Intellectual Property

The Service, including its design, code, text, graphics, logos, icons, and software, is the intellectual property of Aaradhya and is protected by Indian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) the information provided on the Service (including property listings) is accurate, complete, or current; (c) the Service will meet your specific requirements; or (d) defects will be corrected.

You are solely responsible for verifying the accuracy of any property information before entering into a transaction. We are not responsible for any losses arising from your reliance on information provided through the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AARADHYA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total aggregate liability exceed the greater of (a) ₹100 or (b) the amount you paid to Aaradhya in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aaradhya and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

• Violation of these Terms or any applicable law.
• Engagement in fraudulent, abusive, or harmful conduct.
• Non-payment of subscription fees.
• Requests by law enforcement or court orders.
• Discontinuance of the Service (in whole or in part).

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Pune, Maharashtra, India. The language of arbitration shall be English.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, pandemics, power outages, internet disruptions, or actions of third-party service providers.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and Aaradhya regarding the use of the Service, superseding any prior agreements or understandings.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email to registered users and/or a prominent notice on the Service at least 7 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and delete your account.
